Is a rental lease (bloomberg form) valid if the witness line was left blank?
I signed a lease in Oct 07 and the moment I moved in to this semi attatched house all sorts of problems started. First and foremost a roach problem. He exterminated 2x in the past 8 months and told us we had to set up the appointments. The windows a installed poorly, illegal deck (it was fixed), landlord not mowing the lawn, gas line exposed which he put a wooden box over it, water backups. He tried to fix it and all this black stuff came pouring out of our ceiling, which might be mold. I have two small children who wake up every morning with bites all over there bodies. I took them to the MD who said it was bug bites, not bed bugs, thank God!!!!! Oh did I mention there is a illegal tenant living below us? I looked on our NYC.GOV site and there were atleast 12 complaints about this house. I have held back rent until the list we gave him was complete and he did maybe 3 things. Do I have a right to just move which I probably will do.
The witness signature has nothing to do with the content of the lease, does it? Did you cross out stuff at signing? I doubt this is a reason to break the lease.
It seems you have documented a case of uninhabitable property. Continue to document! State and local law govern your tenancy.
It seems your landlord has tried to make corrections and fixes and that is in his favor.
Your landlord has an account with the exterminator, no? And he made arrangements for you to schedule appointments? Why not do so? That is one remedy for roaches--gassing out the building. Call them once a month if it's not on your nickel.
